INTELLECTUAL PROPERTY
What is “Intellectual Property”?
There are four main types of IP, those being copyrights, patents, trademarks and trade secrets. Each has a value to its owner that, while financial, is also intrinsically personal.
David N. Bryman is an expert intellectual property licensing attorney. He has drafted, reviewed and negotiated hundreds of agreements involving many of the world’s most recognized brand names.
Trademarks, trade secrets, copyrights and patented technology should be protected and jealously guarded at all times.
The Bryman firm can register your trademark with the United States Patent and Trademark Office. If you use a fictitious name in your business, commonly referred to as a d/b/a, The Bryman Firm can register the name where appropriate.
Safeguards to protect your valuable IP are essential. Critical to maintaining the propriety of your core assets, The Bryman firm will create Non-Disclosure and Use Agreements with employees, contractors and others with access to your IP information.
As a LICENSOR, you want to grant a defined, narrow set of rights. We must specify a particular market segment or product, limit the territory, provide for proper approvals, and do’s and don’ts to protect the integrity of the brand.
A LICENSEE must make sure the narrow parameters set by the Licensor are feasible for effective usage. All aspects of the subject IP needed for their intended use, including certain images, sounds, names or even style guides should appear in the License Agreement. If appropriate, exclusivity rights need to be addressed.
PATENT LAW, while not handled directly, as the defacto General Counsel for many businesses, The Bryman Firm will work with the client to identify and secure the best third party provider. Through years of experience, we can then assist our client in maximizing the results and minimizing the cost of a patent attorney.
IP DEFENSE: In the unfortunate event that your proprietary assets are misappropriated, The Bryman Firm, clearly understanding the urgency of the matter, will respond quickly, efficiently and effectively to assess the situation and take immediate action. We will move with lightening speed to stop the abuse, address the violation, and prevent a repeat scenario. In IP abuses, TIME IS OF THE ESSENCE.
